Civil Litigation

Some disputes settle. Some you have to fight.

Overview

By the time you’re calling a litigator, something has already gone wrong

An invoice remains unpaid. A contract has been breached. A partnership has collapsed. A statement of claim arrived in the mail.

The first question is not how do we sue. It’s what happened, what we can prove, what the law gives you, and whether the result is worth the cost of getting there. Litigation in Ontario is slow and expensive, and a client is entitled to hear that before deciding, not after.

A word about proportionality

Winning the legal argument and getting a good commercial result are two different things.

We’ve seen files where the right advice was to sue and press the issue hard, and files where the right advice was to take 70 cents on the dollar in month three and go back to work. You are entitled to hear which one we think you have, even when it isn’t what you want to hear.

If you’ve been served with a claim, there are deadlines, and they’re short. Speak to someone before the time to defend runs out.
